These Terms and Conditions ("Terms") govern your access to and use of the Kinetex platform — including our website at kinetex.co.in, our in-store self-checkout kiosks, our mobile applications, and any related services (collectively, the "Service") — operated by KINETEX LLP, a Limited Liability Partnership registered under the Limited Liability Partnership Act, 2008 (LLPIN: ACX-3608), having its registered office at C Block, Flat 506, Savadha, Kollur, Sangareddy, Tellapur, Ramachandrapuram, Medak – 502032, Telangana, India ("Kinetex", "we", "us", or "our").
By accessing the Service, registering an account, or completing a purchase at a Kinetex-powered store, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Eligibility
You must be at least 18 years of age and legally capable of entering into binding contracts under Indian law to use the Service. By using the Service you represent that you meet these requirements.
2. Account registration
- You may register using your mobile number (verified by OTP) or your Google account.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted under your account.
- You agree to provide accurate, current and complete information and to update it as required.
- We may suspend or terminate accounts that contain fraudulent, misleading or impersonating information.
3. Use of the Service
You agree to use the Service only for lawful purposes. You will not:
- Attempt to gain unauthorised access to any part of the Service or its supporting infrastructure.
- Reverse-engineer, decompile, scrape, or otherwise extract source code, data, or system internals.
- Use the Service to transmit malware, conduct denial-of-service attacks, or engage in any activity that disrupts the Service.
- Use the Service to defraud merchants, customers, or payment processors.
- Resell, sublicense, or commercialise the Service without our written consent.
4. In-store purchases and payments
When you complete a purchase at a Kinetex-powered store:
- The contract of sale for the goods is between you and the operating retailer (the "Merchant"). Kinetex provides the technology platform; we are not the seller of goods unless explicitly stated.
- Payments are processed through authorised payment gateways (PhonePe Payment Gateway or equivalent), regulated by the Reserve Bank of India.
- Prices, taxes (including GST), and item availability are determined by the Merchant.
- A digital receipt is generated and stored against your account at the time of payment.
5. Loyalty programme & wallet
- Loyalty points and store wallet balances accrued through the Service are issued by the Merchant or by Kinetex on behalf of the Merchant.
- Points and wallet balances have no cash redemption value and cannot be transferred to another account.
- We may, at our discretion and with prior notice, modify the conversion rate, expiry rules, or the loyalty programme itself.
6. Biometric data (face recognition)
If a participating store uses Kinetex's biometric welcome-display feature, you may choose to register a face profile. Face data is processed in compliance with the DPDP Act, 2023. The raw camera image is not retained; only an irreversible 128-dimensional mathematical embedding is stored, encrypted at rest. You may withdraw consent and delete the data from the Kinetex mobile app at any time. Full details are in our Privacy Policy.
7. Intellectual property
All content, software, designs, trademarks, and logos comprising the Service are owned by KINETEX LLP or its licensors and are protected under Indian intellectual property law. No license is granted to use any of the above except as strictly necessary to use the Service.
8. Refunds, returns, and cancellations

9. Service availability
We aim to maintain high availability but do not guarantee uninterrupted access. The Service may be unavailable due to maintenance, payment-gateway outages, network issues, or events beyond our reasonable control. We are not liable for losses arising from such interruptions.
10. Limitation of liability
To the maximum extent permitted by law, Kinetex's aggregate liability arising out of or relating to the Service, in respect of any cause of action, shall not exceed the total amount paid by you to Kinetex (excluding amounts paid to the Merchant for goods) in the six (6) months immediately preceding the event giving rise to the claim. We shall not be liable for any indirect, incidental, special, punitive, or consequential damages.
11. Indemnification
You agree to indemnify and hold harmless KINETEX LLP, its partners, employees, and affiliates from any claim, loss, liability, or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Service, or your violation of any applicable law.
12. Termination
We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have breached these Terms or applicable law. You may close your account at any time by emailing support@kinetex.co.in.
13. Changes to these Terms
We may revise these Terms from time to time. Material changes will be communicated via the mobile app or email. Continued use of the Service after a revision constitutes acceptance of the updated Terms.
14. Governing law and jurisdiction
These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts at Sangareddy, Telangana.
